Unfair Competition: Mtre Julien Ouellet signs with Wilson Lafleur for a Legal Treatise

LJT Lawyers is proud to announce that one of our litigation department attorneys, Mtre Julien Ouellet, has completed drafting his legal treatise on the passing off action in Canada, which will be published by Éditions Wilson & Lafleur, Martel, Ltd.

Mtre Ouellet joined the LJT Lawyers team in January 2023. Called to the Quebec Bar in 2015, he practiced civil and commercial litigation for nearly seven years before pursuing a Juris Doctor in North American Common Law. Alongside his practice at LJT Lawyers, he completed a Master of Laws with honors at the University of Montreal, focusing his thesis on the action of passing off in Canada. Combining his strong theoretical training with his practical experience in the field, Mtre Ouellet approached his research and writing work rigorously from the outset, with a view to an eventual publication intended for his peers. His jury, composed of Professors Pierre Larouche and Ysolde Gendreau, awarded him the mention “Excellent”.

Since then, Mtre Ouellet has continued to refine his cutting-edge expertise in unfair competition by adding new sections to his already extensive work, in order to transform it into a complete monograph on “L’action en commercialisation trompeuse au Canada” (The passing off action in Canada). His treatise meticulously and thoughtfully addresses the analogous legal claims for passing off, based on the common law tort of passing off (in Canada, outside Quebec), the doctrine of unfair competition by confusion (under Quebec civil law), and the statutory tort under section 7(b) of the Trademarks Act (under federal law, nationwide). This action essentially provides remedies to a trader when another passes off their products, services, or business as those of the first trader, thereby misappropriating its goodwill or reputation. The publication of his legal treatise is expected by the end of the first quarter of 2025.
